Resolving Your ICBC Claim 

Resolving your ICBC Claim can be a daunting task.

Without a lawyer, an injured person is left to trust an ICBC adjuster as to the value of their claim.  It is important to remember that an ICBC adjuster does not owe the injured person a legal duty of fairness.  In fact, the courts have commented that an adjuster's job is to settle claims as quickly and cheaply as possible.

Rather than trusting an adjuster to determine the value of a claim, we work with medical professionals, engineers, accountants, rehabilitation therapists and other expert witnesses to ensure our clients maximize their physical recovery and receive fair compensation from ICBC.

There are three ways that your case can be resolved:

Negotiation

Most ICBC cases are resolved through negotiation between the lawyer and the adjuster.  The adjuster will often make an early offer on your file.  It is generally not advisable to accept this early offer since you will rarely be fully recovered from your injuries when this offer is made.  When the time is right to negotiate a settlement, a number of offers and counter-offers may flow between the lawyer and the adjuster.  You will be advised by us if ICBC's negotiated offer is reasonable or not.  You are the ultimate decision-maker. We have the experience to properly prepare your case to negotiate from a position of strength.  Mr. Gantzert has negotiated $1,000,000s of settlements for his clients.

Mediation

A mediation is often a successful  method for resolving ICBC claims,  and involves meeting with the ICBC adjuster, ICBC's lawyer, and an impartial mediator agreed to by both ICBC and your lawyer.  Your lawyer will be beside you throughout the mediation and you will always have the opportunity to discuss matters with your lawyer in private during the mediation. You cannot be forced to settle your claim during mediation, but reasonable settlements are often obtained.

Trial
